” The week of April, 1, Cloud V enterprises filed a lawsuit in federal court asserting that Cloud Vapez, Inc. is infringing its trademarks and copyrights, and unlawfully interfering with its business. The case is pending in the United States District Court for the Central District of California.
As alleged in that case, the Cloud vaporizer was first developed by Vahan Eksouzian, one of two principals of Cloud V Enterprises. Brett Albanese joined the principals of Cloud V Enterprises and formed a company to promote and market the Cloud vaporizer.
Instead, Mr. Albanese misappropriated the product design, the packaging design, and even the name “Cloud”, and began selling knock-off vaporizers through his newly formed company, Cloud Vapez, Inc. Cloud Vapez, Inc. even tried to divert business by setting up its company and website with a confusingly similar name to that of Cloud V Enterprises domain name – http://www.cloudvapes.com.
To trade off of the goodwill from the sale of the “Cloud” vaporizer, Cloud Vapez, Inc. began calling its vaporizer the “Cloud2.0” to suggest that it is an improved version of the original “Cloud” vaporizer. However, the “Cloud2.0” vaporizer sold by Cloud Vapez, Inc. is made by a different manufacturer with inferior, cheaper parts. As a result, Mr. Eksouzian says, “Cloud V Enterprises has received countless complaints about the Cloud2.0.
We have to tell these complaining customers that we have nothing to do with the so-called ‘Cloud2.0’ that they purchased from Cloud Vapez, Inc. We feel bad that these customers have been duped by Mr. Albanese and his company. We hope that our lawsuit will prevent even more customers from being deceived by Cloud Vapez, Inc.’s knock-offs”
